Yeah, I agree. Maybe not removed though, but rather updated.
The LBA 3 post on that thread can also be updated, if someone would write something decent to post there (I don't know all the info, so I won't do it myself).

No it shouldn't be removed because Fred doesn't own all the rights. Until he does own all the rights he can't make LBA free (free as in beer) or 'gratis'.

I think perhaps we can take more from what Frederick said- after all while he did indeed state that he cannot make legal to abandonware-ise LBA, he also said people who hosted the game for download would not get into trouble.

It's a toughy.

Illegal = illegal
case closed. So as long as LBA has not been liberated I won't change that rule. Also the rule about linking to "abandonware sites" will remain in tact.

I agree with El_Muerte.

Fred said what he said because he knows lba is hard to get, and said that not as a consent, but as "I don't mind if you share LBA, your not going to get into trouble from me, but do it under the ropes (ie. not publicly).

Another words, he agrees with the idea of it becoming available freely, but he can't make that official yet. I'd hate the idea of us releasing it for free download and endorsing it with Fred's personal opinion to us. How disregardful would we look from Fred's point of view?

Even worse, if we did that, that could put Fred in a position legally to be sued for endorsing the rights of a game he doesn't own the rights to.

Who own's the rights - he knows, but doesn't want us to.

Why? - Because he doesn't want people contacting them about the rights, because hes trying to convince them to sell them, and people enquiring about the rights may encourage them to feel they can charge more for releasing them to him, which means we might not get our lba3. - (refer to the Frederick Raynal email thread in General for more info on this)
