I wonder how all of a sudden they are able to do it, given the plenty of excuses they've been giving us for the past 20 years for not doing it. I mean, so now they have the money, the rights, (possible) publishers and all the shenanigans? Well, cool

The rights were secured a long time ago. Money and taking the risk has always been the concern.
Remember than while they were No Cliche they were Sega exclusive, and didn't have the rights.

yeah maybe they settled for a lower budget and chose to just do it. or a studio came along, but I don't know anything about their history or their credentials

They may have a budget now, but not entirely.
I think they will create a prototype of the game and at some stage create a crowdfunding to raise more money and complete the game.

Anyway, it's great to see it happen and with no copyright restrictions.
